General Terms of Use of Caloria

Welcome to Caloria. These General Terms of Use (the "Terms") govern your use of the Caloria mobile application (the "Application") and associated services (the "Services"). By accessing or using Caloria, you fully accept these Terms as well as our Privacy Policy, incorporated by reference. If you do not accept these Terms, you must not use our Services.

Caloria is an application developed by Business Plume ("we," "our," "us"), which allows you to analyze your meals via photos and track your calories and macronutrients (macros) in real-time to achieve your personal goals.

1. Use of Services

1.1 Eligibility

  • You must be at least 17 years old to use Caloria. In France, the minimum age is 18 years. Any use by individuals below these ages is strictly prohibited.

1.2 Features of the Services

  • Meal Analysis: Caloria uses artificial intelligence (AI) to analyze photos of your meals and estimate their nutritional values (calories and macros).
  • Daily Goals: During onboarding, we ask you questions to establish your daily calorie and macro goals. These goals can be modified at any time via the Application.
  • Language: The Services are available only in French but are accessible worldwide.

1.3 Account Creation and Management

  • To fully use the Services, you may need to create an account via Apple Sign-In or another authentication method. You are responsible for keeping your information accurate and up to date, as well as protecting the confidentiality of your login credentials.
  • In case of unauthorized access, contact our support service immediately.

1.4 Updates and Suspension

  • We may automatically update the Application to improve the Services. You must install these updates to ensure optimal functioning.
  • We reserve the right to suspend or terminate your access to the Services in case of violation of these Terms or for technical or legal reasons.

2. Paid Services

2.1 Premium Subscriptions

Caloria offers a premium subscription with the following features:

  • Analysis of meal photos.
  • Manual correction of AI-generated analyses.

Subscription Options:

  • 12 months: 49.99 euros (paid in full).
  • Monthly: 9.99 euros per month.
  • Free Trial: 7 days offered to new users.

2.2 Payment

  • Payments are managed via RevenueCat, a third-party service. By subscribing, you authorize automatic debits through your chosen payment method.
  • Fees are non-refundable, except at our discretion.

2.3 Free Trial

  • The 7-day free trial provides access to all premium features. At the end of this period, the subscription automatically renews at the chosen rate unless canceled beforehand.

2.4 Renewal and Cancellation

  • Subscriptions automatically renew at the end of each period (monthly or annually) unless you cancel via the Application settings or by contacting our support service.
  • Cancellation takes effect at the end of the current billing cycle.

3. Use of AI and Liability

  • Accuracy of Analyses: Caloria uses AI to analyze meal photos. While we aim for high accuracy, the results are not 100% guaranteed. You are responsible for verifying the information provided and consulting a healthcare professional if necessary.
  • Disclaimer: Caloria cannot be held liable for errors or omissions in the AI analyses. The Services are provided for informational purposes and do not replace medical or nutritional advice.

4. Data and Privacy

  • Data Collection and Storage: We collect and store your daily goals (calories and macros) as well as meal photos and associated analysis data for premium users. This data is stored via Supabase, a third-party service, and is used solely to provide and improve the Services, including the manual correction feature for analyses.
  • Meal Photos: The photos you submit for analysis are retained to allow manual correction of analyses as part of the premium subscription. They are not shared with third parties without your explicit consent, in accordance with the GDPR (General Data Protection Regulation).

5. Absence of Community Features

  • Caloria does not offer any community or social features. The Services are designed for individual use only.

6. Third-Party Services

Caloria relies on third-party services:

  • RevenueCat: Subscription management.
  • Supabase: Storage of daily goals, meal photos, and analysis data.
  • Apple Sign-In: User authentication.

These services are subject to their own terms and policies. We are not responsible for their actions or omissions.

7. Intellectual Property

  • User Content: You retain ownership of the meal photos you submit. By uploading them, you grant us a worldwide, non-exclusive, and free license to process and store them as part of the Services.
  • Caloria Content: All content created by Caloria (interface, analyses, etc.) belongs to Business Plume and may not be used for commercial purposes without authorization.

8. Applicable Law and Disputes

  • These Terms are governed by French law and comply with the GDPR (General Data Protection Regulation) for users in the European Union.
  • Any dispute will be subject to the exclusive jurisdiction of the French courts.

9. Modifications to the Terms

  • We may modify these Terms at any time. Changes will be posted in the Application and, if necessary, notified by email. Your continued use of the Services constitutes acceptance of the new Terms.
